PROMOTIONAL PERIOD

The Promotional Period starts on October 5, 2020 at 10:00 am CST and ends on November 1, 2020 at 10:00pm CST.

ELIGIBILITY

This sweepstakes is open to legal residents of all 50 states and the District of Columbia, 18 years of age and older.  Employees, directors, officers, owners, and franchisees of the Sponsor or of any Erbert & Gerbert’s Sandwich Shop locations, and their respective affiliates, subsidiaries, partners, vendors and agencies (the “Promotion Parties”), and members of their immediate families or persons living in the same household, are ineligible.  Void in Puerto Rico and where prohibited.

HOW to ENTER

To enter the sweepstakes, you may either:  (1) Place an online order in excess of $10 (food and beverage only) with a participating Erbert & Gerbert location using the Erbert & Gerbert’s website while logged in to your Sandwich Society account or the Erbert & Gerbert’s mobile rewards app, or (2) Fax a form with your name, address, email address and phone number to: 715-833-8523, or (3) Mail in an entry with your name, address, email address and phone number to the Sponsor address below by October 20, 2020. All sweepstakes entries must be complete and received by Sponsor’s electronic systems in accordance with the following schedule.  Entries must be received:   By 11:59 pm CST on October 11, 2020, for the drawing to be held on October 12, 2020; By 11:59 pm CST on October 18, 2020, for the drawing on October 19, 2020; By 11:59 pm CST on October 25, 2020, for the drawing on October 26, 2020; and By 11:59 pm CST on November 1, 2020, for the drawing on November 2, 2020.

Limit one (1) entry, per household, per day, regardless of entry method.  No mechanically reproduced or photocopied entries will be accepted.  Incomplete entry forms and entries received after the dates and times specified in these Rules will be disqualified.  Not valid on in-store orders.  Online Sandwich Society orders with participating locations only.  Entries become the property of E&G Franchise Systems, Inc. (the “Sponsor”).

PRIZES

Four (4) weekly prizes will be awarded, one for each week during the Promotional Period.  Each prize will be a $100 Erbert & Gerbert’s gift card. Approximate retail value:  $100.  

Limit one prize per household. Prize is not transferable. Sponsor reserves the right to substitute a prize of equal or greater value, in Sponsor’s sole discretion. If a potential winner cannot be notified, fails to claim a prize as specified in these Rules, or is disqualified for any reason, in Sponsor’s sole discretion, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries for that weekly drawing. Only one alternate drawing will be held per week, after which the prize will remain un-awarded.

ODDS of WINNING

Chances of winning will depend on the number of qualifying entries received.

WINNER SELECTION & NOTIFICATION

A weekly random drawing will be conducted by Sponsor on the following dates: October 12 (Drawing #1), October 19 (Drawing #2), October 26 (Drawing #3) and November 2 (Drawing #4), from all eligible entries received during the week the drawing is held.  Entries submitted during one week will not qualify for drawings in subsequent weeks. Potential winners will be notified by email sent to the email address provided in the sweepstakes entry.

CLAIMING a PRIZE

Upon receiving a prize notification from Sponsor, potential winners must follow the instructions in the notification.  The potential winner must sign and return any required Affidavit of Eligibility and Release within 7 days of the date notice is sent or such other date set by Sponsor.  Failure to satisfactorily complete and return such form(s)within the applicable time period will result in forfeiture of the prize and Sponsor may award the prize to an alternate winner. All income taxes resulting from acceptance of prize are the responsibility of winner. By accepting a prize, winner consents to Sponsor’s and the Promotion Parties’ unrestricted use of winner’s name, image, likeness, voice, statements about the Sponsor or the sweepstakes, biographical information, and sweepstakes entry, including for news, publicity, public relations or marketing purposes, without further compensation or right of approval.

DISCLAIMER

By entering this sweepstakes, entrant accepts and agrees to these Official Rules and the decisions of the Sponsor, which shall be final in all matters. By entering this sweepstakes, entrants waive all right to, and hold harmless Sponsor and the Promotion Parties from, any claim, liability, loss, damage (including punitive, incidental and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this sweepstakes or the acceptance, use, or misuse of any prize.  Prizes are awarded “as is” with no warranty or guarantee, express or implied.

SWEEPSTAKES ADMINISTRATION

If for any reason the sweepstakes is not capable of running as planned, including disruptions caused by force majeure, pandemic, systems malfunctions, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause that corrupts, affects, or compromises the administration, security, fairness, integrity, proper conduct or intended play of the sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any individual(s) that Sponsor deems responsible and Sponsor further reserves the right to cancel, terminate, modify or suspend the Sweepstakes. 

Sponsor and Promotion Partners assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries. Sponsor and Promotion Partners are not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any e-mail or entry to be received by Sponsor due to technical problem or traffic, congestion on the internet or at any website, or any combination thereof, including any injury or damage to entrant’s, or any other person’s computer, related to or resulting from participation or downloading/uploading any materials in this Sweepstakes. ANY ATTEMPT BY ANY PERSON OR ENTITY TO DELIBERATELY DAMAGE ANY WEBSITE OR APP OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS.  SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON OR ENTITY, TO THE FULLEST EXTENT PERMITTED BY LAW.  Sponsor and Promotion Partners are not responsible for: lost, late, misdirected, damaged, illegible, incomplete, incorrect or postage due entries; lost, late, misdirected prize notices; or any typographical or other error in the printed or online advertising materials and sweepstakes forms; or in the administration of the sweepstakes or announcement of the prize. In the event of any such error, Sponsor reserves the right to cancel or modify this sweepstakes in a manner deemed appropriate by the Sponsor, at its sole discretion. All federal and state laws apply.

PRIVACY

Any information submitted by entrants will be treated in accordance with Sponsor’s privacy policies.  Entry in the sweepstakes constitutes consent to be added to the Sponsor’s direct mail, mobile and Internet marketing databases.  Entrants can opt-out of receiving offers and emails at any time by contacting Sponsor and opting-out does not impact the chances of winning.

DISPUTE RESOLUTION, CHOICE of LAW and FORUM

1. Entrant agrees that all matters arising out of or relating to this sweepstakes and these Official Rules are governed by, and construed in accordance with, the laws of Wisconsin, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action or proceeding arising out of or relating to this sweepstakes and these Official Rules shall be brought exclusively in the applicable state courts located in Eau Claire, Wisconsin or the applicable federal courts located in Madison, Wisconsin. Except where prohibited, by participating in this sweepstakes, each entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this sweepstakes, or awarding or use of a prize, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will any participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
